In the death of Kenny, the USDA charged Ringling with “Animal Welfare Act Violations in the failure to provide veterinary care,” and Ringling paid $20,000 to settle out of court (August 28, 1998). The USDA concluded: Kenny, the baby endangered Asian elephant, was forced to perform in Jacksonville, Florida, despite obvious illness. He was found dead hours later in a pool of bloody diarrhea.
